if your partner has a open sore but it's near the base & u spit on it will he get hsv2?

What kind of open sore? Makes it sound like you're saying his open sore is herpes, but that's not what you mean, right? To answer what I think you're asking, if your partner has a break in his skin and you spit on it, will herpes be passed to him? The answer is no. Herpes is passed via skin to skin contact. So unless you had an open herpes sore on your lip (which 99% of the time is HSV-1) and somehow some of the liquid from inside your herpes sore mixed with your saliva and then you spit on your partner's break in the skin, that would be the only way that herpes could be passed through the saliva. If there's no active outbreak, then no worries.
